The Zofran Lawsuit

An increased risk of birth defects, including congenital heart problems, has been linked to a widely prescribed anti-nausea medication. Zofran is not approved by the Food and Drug Administration (FDA) for use in pregnancy, but manufacturer GlaxoSmithKline (GSK) has promoted its off-label use to prevent nausea and vomiting during gestation. If your baby suffered a birth defect after you took the medication during the first trimester of pregnancy, the growing Zofran lawsuit may be pertinent to you. Our San Diego, CA, law firm is representing plaintiff families who have suffered losses because of this drug.

It is dangerous and unethical for a company to market pregnancy medication that has not been proved safe for developing babies. Our pharmaceutical injury attorneys believe victims of this practice deserve full legal compensation. We have years of experience assisting plaintiffs with compassionate, aggressive representation. If your family has been impacted by Zofran, we encourage you to contact us today for a free consultation.

A box of Zofran medicationFDA-approved specifically for cancer patients, Zofran works as a preventive treatment for chemotherapy side effects. However, GSK marketed the medication to OB-GYN physicians, indicating that it was a safe and effective treatment for morning sickness. It is common for doctors to prescribe off-label drugs they believe to be safe, but it is unlawful for pharmaceutical companies to promote drugs for off-label uses.

Our team of compassionate, highly skilled attorneys work diligently to assist victims in obtaining just compensation for their losses.

Pregnant women who took Zofran have delivered babies with numerous birth defects. The most serious of these include heart defects which may require surgery or lifelong monitoring, which limits the activities of the growing child. Cardiac conditions associated with Zofran may include:

  • Atrial septal defect (ASD)
  • Other septal defects
  • Tetralogy of Fallot
  • Heart murmurs
  • Myocardial infarction (heart attack)

Many other serious and devastating birth defects have been seen in infants born to mothers who took Zofran. Other congenital birth defects include:

  • Cleft lip
  • Cleft palate
  • Clubfoot
  • Limb defect or abnormality
  • Spina bifida
  • Neural tube defects
  • Anencephaly
  • Kidney defects
  • Skull deformities.

Hundreds of Zofran lawsuits have been filed against GSK from all over the country, and this is not the first time the company has been accused of misconduct. In 2012, GSK paid over $3 billion in fines and restitution for charges of fraud and illegal promotion of several medications. Now, pending complaints again accuse GSK of similar practices, as well as negligence and failure to warn about risks from a dangerous drug. Preliminary animal studies showed the drug passed through the placenta, but no warnings were given to doctors or pregnant patients.

In October 2015, Zofran lawsuits were transferred to multidistrict litigation (MDL) in Massachusetts. MDL plaintiffs retain their own attorneys, but multiple cases are consolidated under one judge for efficient handling of discovery and common questions. Plaintiffs will still receive an individual compensation settlement based on their unique injuries.

Our personal injury law firm handles Zofran cases for injured clients. Our team of compassionate, highly skilled attorneys will work diligently to assist victims in obtaining just compensation for their losses. Money cannot make up for a serious birth injury, but it can help families cope with medical costs and therapeutic treatments.
